Splunk Defeats Non-Practicing Entities in Three Patent Cases

Indeed, the United States Patent and Trademark Office has granted Splunk well over 1,000 patents that recognize and protect Splunk’s inventions. Splunk is committed to safeguarding this investment, and takes intellectual property rights of all parties seriously. So when baseless lawsuits are filed against the company, Splunk strenuously defends against those claims.

Today, Splunk is pleased to share significant victories in the first three patent infringement cases that have ever been filed against the company.

In the first case, Sable Networks, Inc. and Sable IP, LLC sued Splunk in March 2021 in the United States District Court for the Eastern District of Texas for alleged infringement of three patents allegedly directed to router technologies and network data flows. Splunk vigorously defended against Sable’s infringement allegations and filed inter partes review petitions with the Patent Trial and Appeal Board, challenging the asserted patents. After a year of litigation, Sable voluntarily dismissed its action against Splunk with prejudice, and Splunk paid nothing to Sable.

In the second case, PacSec3, LLC sued Splunk in February 2022 in the United States District Court for the Eastern District of Texas for alleged infringement of one patent allegedly directed to the analysis of data packets moving across a network. Again, Splunk vigorously defended against PacSec3’s infringement allegations and filed an inter partes review petition challenging the asserted patent. After only six months of litigation, PacSec3 dismissed its action against Splunk with prejudice, and Splunk paid nothing to PacSec3.

In the third case, Longhorn HD sued Splunk in September 2022 in the United States District Court for the Eastern District of Texas for alleged infringement of two patents allegedly directed to the detection of anomalies and network performance issues within computer systems. After only two months of litigation, Longhorn HD dismissed its action against Splunk with prejudice, and Splunk paid nothing to Longhorn HD.

These victories are particularly notable, not only for their just results, but also because they underscore that Splunk — with over 1,000 patents in its own portfolio — is the true pioneer and continued leader in the data analytics space.
